Messaging Terms (SMS Terms & Conditions)
On this page
These Messaging Terms govern SMS (text) messages sent through the Tanqory platform. They apply to anyone who receives such messages, and they supplement our Terms of Service and Privacy Policy. By opting in to receive messages, you agree to these Messaging Terms.
1. Who Sends the Messages
Messages may be sent by:
- Tanqory, for platform and account notifications — for example security verification codes, login alerts, and service notices; or
- Merchants using the Tanqory platform, to reach their own customers — for example order and shipping updates from a store you purchased from.
In both cases, Tanqory is the technology provider that delivers the messages and acts as the sender of record with United States carriers. For merchant messaging, the merchant is the party that maintains the relationship with you and collects your consent (see Section 11).
2. Program Description
Depending on what you have opted in to, you may receive the following categories of message:
- Order confirmations, shipping updates, and delivery notifications;
- Account and security alerts (including one-time verification codes);
- Customer service and support replies;
- Marketing and promotional messages — only where you have separately opted in to receive them.
3. Consent and Opt-In
You will receive messages only after you have opted in. Opt-in may occur through a web form, during checkout, by texting a keyword to a Tanqory or merchant number, or at a point of sale. Consent to receive messages is not a condition of any purchase. Marketing messages always require a separate opt-in; transactional messages (such as an order confirmation) are sent in connection with a transaction you initiated.
4. Message Frequency
Message frequency varies. The number of messages you receive depends on the message categories you opted in to and on your activity (for example, how many orders you place).
5. Cost
Message and data rates may apply. Any such charges are billed by your mobile carrier under your mobile service plan; Tanqory does not charge you to receive messages.
6. Opt-Out
You may opt out at any time by replying STOP to any message. After you reply STOP, you will receive one final message confirming that you have been unsubscribed, and no further messages will be sent to you for that program. To opt back in, reply START to the same number or re-subscribe through the original opt-in channel (for example, the web form or checkout setting). Opting out of one program (for example, one merchant's messages) does not affect other programs you have separately opted in to.
7. Help
For assistance, reply HELP to any message, email us at legal@tanqory.com, or visit our Help Center at help.tanqory.com. For messages sent by a merchant, you can also contact that merchant directly using the contact details on their storefront.
8. Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages.
9. Supported Carriers and Availability
Message delivery depends on your mobile carrier and network conditions. SMS features may not be available on all carriers, in all countries, or on all number types (for example, some landline or VoIP numbers cannot receive SMS).
10. Privacy
Our Privacy Policy describes how we handle personal data, including the mobile information collected in connection with messaging. Mobile information and phone numbers obtained through SMS opt-in are not sold, rented, or shared with any third parties or affiliates for marketing or promotional purposes. Phone numbers are shared with our communications subprocessors solely to deliver the messages you asked to receive (see the Subprocessor List).
11. Merchant Obligations
Merchants that use Tanqory's messaging features to send SMS to their own customers are responsible for:
- Obtaining and keeping records of valid consent from each recipient before sending messages, and honoring opt-outs;
- The content, accuracy, and lawfulness of the messages they send;
- Complying with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and all other laws applicable in each recipient's country.
Tanqory enforces opt-out handling (STOP/HELP keywords) at the platform level and may suspend or terminate messaging for any merchant that does not comply with these obligations, our Terms of Service, or applicable law.
12. Contact and Entity Details
Messaging through the Tanqory platform to United States recipients is provided by:
Tanqory Inc. (Delaware corporation), the global contracting entity Registered Agent: c/o Harvard Business Services, Inc., 16192 Coastal Highway, Lewes, DE 19958, USA Email: legal@tanqory.com
13. Changes to These Messaging Terms
We may update these Messaging Terms from time to time. The "Last Updated" date at the top of this page shows when they were last revised; material changes will be notified as described in our Terms of Service. Continued participation in a messaging program after an update takes effect constitutes acceptance of the revised terms.
