Domain Services Addendum
On this page
This Domain Services Addendum (“Addendum”) applies when you use Tanqory to register, renew, transfer, or manage a domain name through the Tanqory platform. It forms part of the Merchant Agreement between you and Tanqory Inc. (“Tanqory”). It does not apply to a domain that you register with another provider and only connect to your store; that domain remains governed by your agreement with that provider.
1) Scope and order of precedence
This Addendum covers domain registration, renewal, transfer to and from the Tanqory platform, and related domain management features. Read it together with the Merchant Agreement, the Terms of Service, the Acceptable Use Policy, and the Privacy Policy.
Every domain registration is also governed by the registration agreement of its Registrar of Record and by the policies of ICANN and the registry for the relevant top-level domain. To the extent of any conflict about the registration itself, those agreements and policies prevail over this Addendum. In all other respects, this Addendum prevails over the Terms of Service, the Terms of Sale, and the Refund and Return Policy for domain services. Mandatory rights under applicable law are not affected.
2) Definitions
“Registrar of Record” means the ICANN-accredited registrar that sponsors a domain’s registration with the registry. “Registered Name Holder” means the person or organization recorded as registrant of a domain. “Registry” means the operator of a top-level domain. “Authorization code” means the code, also called an EPP code or auth code, that authorizes the transfer of a domain between registrars. “Transfer Policy” means ICANN’s Transfer Policy, as updated from time to time.
3) Tanqory’s role
Tanqory provides the platform through which you order and manage domain registrations. Tanqory is not the Registrar of Record for any domain. Registrations ordered through Tanqory are made with an ICANN-accredited registrar, which is the Registrar of Record for that domain. The registrar currently used for new registrations is identified in Appendix A, and Tanqory will identify the Registrar of Record for any specific domain on request.
Tanqory is not a registry and does not set registry policies. Tanqory cannot override a decision of a Registrar of Record, a registry, ICANN, a dispute resolution provider, or a court.
4) Registered Name Holder and registrant information
The person or organization whose details are entered as registrant information when a domain is registered, or who is recorded as registrant when a domain is transferred to Tanqory, is the Registered Name Holder. Enter your own details or those of the business that is to hold the domain. Details belonging to someone else will register the domain to that person or organization.
You must provide registrant information that is accurate and complete and keep it current. Inaccurate or incomplete information may lead the Registrar of Record or the registry to suspend or cancel the registration. If you enter information about another person or organization, you are responsible for having their authority to do so and for giving any notice about the use of their information that applicable law requires.
5) Registering a domain
A domain is registered for the registration period you select and pay for at checkout. A domain that appears available is not registered until the Registrar of Record confirms the registration, and Tanqory cannot guarantee that a particular domain will be registered.
Registering a domain gives the Registered Name Holder the right to use it for the registration period, subject to the Registrar of Record’s registration agreement and the policies of ICANN and the registry. Where WHOIS privacy is shown as included at checkout, it is provided for that domain without additional charge, subject to the terms of the Registrar of Record and the rules of the registry.
6) Renewal and auto-renew
You can choose whether a domain renews automatically. If auto-renew is on, Tanqory will attempt to renew the domain for a further period and charge the applicable renewal fee to your payment method. Tanqory renews a domain only after the renewal payment succeeds. If the payment fails, or requires an authentication step that is not completed, the domain will not be renewed and may expire.
If auto-renew is off, you are responsible for renewing the domain before it expires. Changes to domain fees are made in accordance with the Merchant Agreement.
7) Expiration
You are responsible for knowing when your domains expire. Registration, renewal, and expiration notices may be sent to the registrant email address, so use an address that you monitor.
If a domain is not renewed before it expires, it may stop resolving, including for your store, and the Registered Name Holder’s right to use it may end. What happens after expiration, including whether any grace or redemption period applies and any fee to restore the domain, is governed by the policies of the Registrar of Record and the registry. A domain that is not restored may be deleted or become available for registration by others.
8) Transferring a domain to Tanqory
To transfer a domain to Tanqory, you must be the Registered Name Holder or be authorized by them. At your current registrar you will need to unlock the domain, turn off any privacy or protection service that would prevent the transfer, and obtain the domain’s authorization code. Under the Transfer Policy, a domain generally cannot be transferred within 60 days of its initial registration or of a previous transfer between registrars.
When you request a transfer, you choose the number of years to add. Once the transfer completes, the registration is extended by that period, subject to the limits on total registration term set by the Transfer Policy and the registry. Transfers usually take 5 to 7 days and Tanqory cannot shorten that period. A transfer to Tanqory does not by itself change the domain’s DNS records.
The authorization code you provide is used to request the transfer and is stored in encrypted form.
9) Transferring a domain away from Tanqory
As the Registered Name Holder, you may transfer a domain to another registrar in accordance with the Transfer Policy. To do so, the domain must be unlocked and you must obtain its authorization code, which Tanqory makes available to the Registered Name Holder. You then give the authorization code to the registrar you are moving to, and that registrar submits the transfer. Tanqory does not submit transfers away on your behalf.
Tanqory does not deny or reject a transfer request on its own authority. Under the Transfer Policy, only the Registrar of Record may deny a transfer, and only on the grounds that the policy allows, such as evidence of fraud, a reasonable dispute over the identity of the Registered Name Holder, or a request made within 60 days of the domain’s creation or of a previous transfer. If a transfer is requested that you did not authorize, contact Tanqory promptly. The Registered Name Holder may object to a transfer through the Registrar of Record as the Transfer Policy provides.
Once you have given the authorization code to another registrar, Tanqory cannot cancel the transfer. Locking the domain again is not a cancellation, and it may cause the transfer to fail or be delayed. After a transfer has completed, it can be reversed only in the circumstances the Transfer Policy provides, such as by agreement between the registrars involved, the decision of a dispute resolution provider, or a court order.
Transferring a domain away does not by itself change its DNS records. After the transfer, you are responsible for the domain’s DNS configuration, and any Tanqory service that depends on the domain, including its connection to your store, may stop working if that configuration changes.
10) Locks, authorization codes, and account security
Tanqory may keep a domain locked against transfer to help protect it from unauthorized transfer. Tanqory makes unlocking available to the Registered Name Holder in accordance with the Transfer Policy, and will not refuse to unlock a domain or to release its authorization code to the Registered Name Holder solely because of a dispute over payment.
Tanqory may ask you to confirm your identity before it unlocks a domain, releases an authorization code, or makes another change that could affect control of the domain. Keep authorization codes, account passwords, and access to your registrant email secure. Anyone holding a valid authorization code for an unlocked domain may be able to transfer it. Tanqory will never ask you to send an authorization code or a registrar account password to Tanqory by email, chat, or phone.
11) Fees and refunds
Domain fees are charged in accordance with the Merchant Agreement and the Billing and Payment Policy.
Fees for a registration, renewal, or transfer that has been completed are non-refundable, including where the domain is later suspended, cancelled, deleted, or transferred to another registrar before the end of its registration period, except where applicable law requires a refund. If Tanqory confirms that a registration, renewal, or transfer you paid for was not completed, Tanqory will refund the amount charged for it.
12) Suspension, cancellation, and disputes
The Registrar of Record or the registry may suspend, cancel, lock, or transfer a domain registration in accordance with its agreements and policies, including where registrant information is inaccurate, where ICANN or the registry requires it, to correct an error in registration, or to comply with applicable law, a court order, or the decision of a dispute resolution provider.
Domain registrations are subject to ICANN’s Uniform Domain Name Dispute Resolution Policy where it applies to the top-level domain, and to any dispute policy of the relevant registry. Tanqory may also suspend domain services in accordance with the Merchant Agreement.
13) Removing a domain and closing your Tanqory account
Removing a domain from your store disconnects it from the store. It does not cancel the domain’s registration or transfer it to another registrar.
Closing your Tanqory account does not transfer your domains to another registrar. Before you close your account, transfer any domain you want to keep under Section 9. A domain that is not transferred or renewed will expire as described in Section 7.
14) Personal data
To register, renew, or transfer a domain, Tanqory shares registrant information with the Registrar of Record. Where required, the Registrar of Record provides it to the registry, to ICANN, to data escrow providers, and to registration data services. The Registrar of Record and the registry process that information under their own obligations to ICANN and the registry and in accordance with their own privacy notices. Tanqory processes registrant information as described in the Privacy Policy, and registrars used by Tanqory are listed in the Subprocessor List.
15) Liability
Tanqory is not responsible for the acts or omissions of any Registrar of Record, registry, ICANN, dispute resolution provider, or court, or for the loss of a domain caused by its expiration, by inaccurate registrant information, or by a transfer made with a valid authorization code, except to the extent the loss is caused by Tanqory’s breach of this Addendum. Tanqory’s liability in connection with domain services is subject to the limitations in the Merchant Agreement. Nothing in this Addendum limits liability that cannot be limited under applicable law.
16) Changes to this Addendum
Tanqory may update this Addendum. Tanqory will give at least 30 days’ notice of material changes by email or through the Tanqory admin, as the Merchant Agreement provides.
17) Governing law and contact
This Addendum is governed by the laws of Singapore. Any dispute arising out of or in connection with it is subject to arbitration in Singapore under the SIAC Rules, in English, without limiting any non-waivable consumer rights or statutory remedies.
Questions about this Addendum may be sent to legal@tanqory.com. For help with a domain, contact merchant-support@tanqory.com.
