DMCA Notice and Takedown Policy
On this page
1) Purpose
This Policy describes how Tanqory receives, evaluates, and responds to claims of copyright infringement involving material made available through Tanqory services. It is intended to (a) implement the notice and takedown procedures of 17 U.S.C. §512 of the United States Digital Millennium Copyright Act ("DMCA"), (b) implement the notice and action obligations of Articles 16 and 17 of EU Regulation 2022/2065 (the Digital Services Act, or "DSA"), and (c) operate consistently with Part 10 of the Singapore Copyright Act 2021. This Policy is incorporated by reference into the Terms of Service and the Acceptable Use Policy.
2) Scope
This Policy applies to copyrighted material stored at the direction of users on Tanqory services, including merchant storefronts, product listings, theme and app marketplace assets, blog and academy content, developer-uploaded code, media files, and user comments. This Policy does not govern (a) infringement claims against Tanqory's own first-party content, which are handled by Tanqory's legal team directly, or (b) trademark, right of publicity, or other non-copyright claims, which are handled under the Acceptable Use Policy.
The contracting party for material hosted by Tanqory services is Tanqory Inc., which also acts as the United States service provider for purposes of 17 U.S.C. §512; Tanqory OÜ acts as the EU representative for purposes of EU Regulation 2022/2065 Article 13.
3) Designated DMCA agent
In accordance with 17 U.S.C. §512(c)(2), Tanqory designates the following agent to receive notifications of claimed infringement:
- Designated agent: the Company's designated DMCA agent. Registration with the United States Copyright Office is pending; in the interim, notices must be sent to legal@tanqory.com and dmca@tanqory.com. Tanqory will publish the agent's Copyright Office registration details on this page upon completion of filing under 17 U.S.C. §512(c)(2).
- Service provider: Tanqory Inc.
- Registered agent address: c/o Harvard Business Services, Inc., 16192 Coastal Highway, Lewes, DE 19958, United States
- Email: dmca@tanqory.com
- Telephone: the agent telephone number on record with the United States Copyright Office; until registration is completed, notices should be sent by email to legal@tanqory.com.
The agent's registration with the U.S. Copyright Office must be renewed every three years under 17 U.S.C. §512(c)(2) and 37 C.F.R. §201.38. Tanqory will publish any change to agent contact details on this page and update the Copyright Office registration concurrently.
4) Notice requirements (the six elements of §512(c)(3)(A))
A notification of claimed infringement must be in writing and must include the following six elements, each of which is required by 17 U.S.C. §512(c)(3)(A):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Tanqory to locate the material — typically the full URL on a Tanqory-operated domain.
- Information reasonably sufficient to permit Tanqory to contact the complaining party — name, postal address, telephone number, and, if available, email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
A notification that does not substantially comply with elements (2), (3), and (4) above will not be deemed to provide actual knowledge of infringement under §512(c)(3)(B). Tanqory will, in such cases, attempt to contact the complainant once to seek the missing elements before closing the matter without action.
5) Submission channels
Notifications may be submitted through any of the following channels:
- Email: dmca@tanqory.com (preferred for fastest processing)
- Mail (registered agent): Designated DMCA Agent, Tanqory Inc., c/o Harvard Business Services, Inc., 16192 Coastal Highway, Lewes, DE 19958, United States
- Online form: the online notice form published at legal.tanqory.com (or by email to legal@tanqory.com)
For notices brought under the EU DSA notice-and-action mechanism, the form additionally collects (i) a sufficiently substantiated explanation of the reasons why the individual or entity considers the material to be illegal content, (ii) a clear indication of the exact electronic location of the material, (iii) the name and email address of the notifier (except for notices concerning offenses set out in Articles 3 to 7 of EU Directive 2011/93/EU), and (iv) a statement confirming the notifier's good faith belief that the information is accurate and complete, as required by DSA Article 16(2).
6) Counter-notification procedure (§512(g))
A user whose material has been removed or disabled may submit a counter-notification under 17 U.S.C. §512(g)(3). A counter-notification must be in writing and must contain:
- A physical or electronic signature of the subscriber.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- The subscriber's name, postal address, and telephone number, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or, if the subscriber's address is outside of the United States, for any judicial district in which Tanqory Inc. may be found, and that the subscriber will accept service of process from the person who provided the original notification or an agent of such person.
Upon receipt of a compliant counter-notification, Tanqory will forward a copy to the original complainant and will replace the removed material or cease disabling access to it not less than 10 nor more than 14 business days following receipt of the counter-notification, unless the complainant first notifies Tanqory that an action has been filed seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material.
7) Repeat-infringer policy (§512(i))
In accordance with 17 U.S.C. §512(i)(1)(A), Tanqory has adopted and reasonably implements a policy that provides for the termination, in appropriate circumstances, of subscribers and account holders who are repeat infringers. Tanqory will record each instance of (a) a takedown effected following a compliant §512(c)(3) notice where no compliant counter-notification was timely submitted, or (b) a final judicial determination of infringement. Account-level action escalates as follows:
- First confirmed infringement: written warning to the account holder.
- Second confirmed infringement within 12 months: temporary suspension of the storefront, content, or account for a period determined by the severity and nature of the infringement.
- Third confirmed infringement within 12 months, or any single egregious infringement (including but not limited to commercial-scale piracy): permanent termination of the account.
Counter-notifications that are subsequently sustained do not count toward the infringement total. Final action may be taken earlier in cases involving clear evidence of bad faith.
8) Bad-faith notice penalties (§512(f))
Any person who knowingly materially misrepresents under 17 U.S.C. §512 (i) that material or activity is infringing, or (ii) that material or activity was removed or disabled by mistake or misidentification, is liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by Tanqory, who is injured by such misrepresentation. Tanqory reserves the right to pursue §512(f) claims and to refer abusive notice patterns to law enforcement.
9) Coordination with EU DSA notice-and-action
Tanqory operates a single notice-and-action mechanism that satisfies both 17 U.S.C. §512(c)(3) and EU Regulation 2022/2065 Article 16. For notices arising under EU law, Tanqory also provides:
- A statement of reasons under DSA Article 17 to each affected recipient of the service when content is removed, demoted, or restricted, or when an account is suspended or terminated, except where such notice would conflict with a legal prohibition.
- Out-of-court dispute settlement under DSA Article 21 through a certified body in the Member State of the recipient.
- Internal complaints handling under DSA Article 20.
Tanqory OÜ acts as the legal representative of Tanqory in the European Union for purposes of DSA Article 13.
10) Response timelines
Tanqory targets the following response timelines, measured from receipt of a substantially compliant notice during normal business hours:
- Acknowledgement of receipt: within 2 business days.
- Initial action on clearly infringing material (e.g., verbatim copying of a registered work): within 5 business days.
- Initial action on materially complete but contested notices: within 10 business days.
- Forwarding of counter-notifications to the original complainant: within 2 business days of receipt.
These targets are operational and do not modify the statutory standard, which is "expeditious" removal under §512(c)(1)(C) and "without undue delay" under DSA Article 16(6). Targets may be extended for notices received outside normal business hours, for incomplete notices pending clarification, and for notices implicating complex questions of fair use, fair dealing, or jurisdictional law.
11) Recordkeeping
Tanqory retains the following records for at least seven (7) years following the calendar year of receipt: the original notice, supporting attachments, internal evaluation notes, action taken, counter-notification (if any), final disposition, and the affected account identifier. Personal data within these records is processed under the Privacy Policy and the Records of Processing Activities. Records may be retained longer where retention is required by law, by a litigation hold, or by an open law-enforcement matter.
12) Annual transparency report
In accordance with the Annual Transparency Report and EU DSA Articles 15 and 24, Tanqory publishes annually, in aggregate and non-identifying form:
- The number of DMCA and DSA notices received.
- The number of notices acted upon, broken down by action type (removal, disablement, demotion, account suspension, account termination, no action).
- The median and 90th-percentile time to action.
- The number of counter-notifications received and the number sustained.
- The number of repeat-infringer terminations.
- The number of out-of-court dispute settlement matters and outcomes.
The first publication cycle covering this Policy is for the calendar year 2026 and will appear in the Annual Transparency Report. See transparency/annual-transparency-report.md.
13) Limitations and disclaimers
Tanqory is not a court and does not adjudicate the underlying merits of any copyright claim. Action taken under this Policy is administrative, not adjudicative, and does not constitute a legal opinion or admission. Where a claim presents a substantial question of fact or law (including questions of fair use under 17 U.S.C. §107, fair dealing under Singapore Copyright Act Division 5, or DSM Directive Article 17 exceptions), Tanqory may elect to leave material in place pending judicial resolution, and to advise the complainant to seek a court order.

15) Adoption note
This Policy was adopted by Tanqory effective 28 May 2026. It is subject to periodic review by Tanqory's legal team and to revision upon material change in law, including any revision to 17 U.S.C. §512, the EU Digital Services Act, the Singapore Copyright Act, or any successor instrument. Material revisions will be published on this page with a revised effective date and version number.
